Hershey Successfully Defends Against Class Action Lawsuit
A federal judge recently ruled in favor of Hershey, dismissing the complaint on the grounds that the customers did not suffer any tangible harm.
The lawsuit, filed in southern Florida, accused Hershey of deceptive packaging for pumpkin- and ghost-shaped candies that promised intricate designs but delivered plain treats. The customers felt misled and sought damages for the alleged misrepresentation.
Hershey countered the claims by asserting that the customers still received delicious Reese’s candy, and there was no evidence of any defects or flavor discrepancies. The packaging also included images of the candies without designs and a disclaimer regarding the artistic renderings.
The initial lawsuit sought damages of at least $5 million, but Hershey’s successful defense prevented any financial liability.
Anthony Russo, the plaintiffs’ attorney, clarified that the court’s decision was procedural and not a judgment on the case’s merits. He emphasized their commitment to ensuring truthful and non-misleading labeling for consumers.
Hershey introduced new Halloween products this year, including collaborations with Peanuts characters and spooky twists on classic candies like Kit Kats and Twizzlers.
Earlier in the year, Hershey announced a price increase for its products due to rising cocoa costs. Despite this, the company reported strong earnings in its recent financial results, driven by early shipments of Halloween candy and consumer enthusiasm for “summer-ween.”
